This policy explains what data CasaQuest collects and why; how we use, share, and secure it; your rights; and our compliance with TCPA calling/texting rules, carrier-mandated A2P 10DLC disclosures, Do-Not-Call obligations, Georgia record-retention periods, state privacy statutes (e.g., CCPA), and COPPA safeguards for children. It incorporates the FCC’s latest consent guidance, CTIA’s 2023 Messaging Principles, Twilio’s A2P overview, FTC DNC requirements, and Georgia Real Estate Commission retention rules.

1. Who We Are

CasaQuest Realty, LLC is a licensed real estate brokerage, wholly owned by CasaQuest, Inc. This Policy applies to both entities collectively referred to as “CasaQuest,” “we,” “our,” or “us,” unless context requires otherwise. Our principal office is located at 1349 W Peachtree Street NE, Suite 1910, PMB 255, Atlanta, GA 30309 (GA broker lic. #82240).

2. Scope

This Policy applies to casaquest.com, any mobile sites or apps we operate, and our email, voice, and text/SMS communications.

3. Information We Collect

Contact: Name, email, postal address, phone (user-supplied)
Transaction: Listing details, offer terms, property preferences (user-supplied)
Device/Usage: IP address, cookies, browser metadata (automated)
Communications: Call recordings, voicemails, chat logs, SMS content (user & automated)
Consent Logs: Timestamp, opt-in method, disclosure text (automated)

4. How We Use Data

Provide brokerage services, match you with listings and agents, and facilitate closings.
Send transactional updates you request (appointments, offer status).
Marketing (calls/texts/emails) only with valid consent or as otherwise permitted by law.
Detect fraud, comply with legal obligations, and maintain security.

5. Legal Bases

We rely on (i) your consent, (ii) performance of a contract, (iii) legitimate interests, or (iv) legal obligations (e.g., broker-record rules).

6. Text Messaging Notice (A2P 10DLC & TCPA)

CasaQuest may send automated text messages to the mobile number you provide. Msg & data rates may apply. Reply STOP to cancel or HELP for assistance; requests are honored promptly. You may also revoke consent by emailing privacy@casaquest.com or calling (770) 480-0621. We add opt-outs to our internal Do-Not-Call list and scrub campaigns against the National and State DNC registries.

7. Sharing & Disclosure

Affiliated agents, MLS boards, lenders, inspectors, and settlement providers involved in your transaction.
Service providers (CRM, cloud hosting, SMS gateway) bound by confidentiality.
Government agencies or courts when legally required.

We never sell your personal data.

8. Cookies & Tracking

We use first- and third-party cookies for analytics, personalization, and advertising. Manage cookies in your browser.

9. Data Retention

Transaction files are kept for three (3) years per Georgia Real Estate Commission Rule 520‑1‑.10. Marketing-consent records are retained at least four years for TCPA compliance.

10. Security

We maintain administrative, technical, and physical safeguards (e.g., TLS encryption, role-based access, staff training).

11. Your Choices & Rights

Opt-out of marketing via STOP, the unsubscribe link, email, or phone.
Residents of CA, CO, CT, UT, VA, and others: access, delete, or correct your data.
GDPR users (EEA/UK): additional rights like portability, objection, restriction.

12. Children’s Privacy

We do not knowingly collect data from anyone under 13. We delete such data if discovered, in compliance with COPPA.

13. International Transfers

If we transfer data outside the U.S., we use appropriate safeguards (e.g., EU standard contractual clauses).
